Holiday or residential letting in Alicante: choosing the right regime

Albufereta beach and residential buildings in Alicante

The first question is not simply what a property might earn, but which use is lawful and practical for that specific home. Holiday, permanent residential and temporary residential letting serve different needs. This guide was reviewed on 1 November 2026; check the rules again before signing or advertising.

Start with the actual purpose

The current Spanish Urban Leases Act distinguishes a habitual home, which meets the tenant’s housing need, from a temporary home needed because of a justified and provable temporary displacement. Following the October 2026 amendment, a temporary contract must state the real reason. Calling it “seasonal” does not make it so, and the law sets consequences when the cause is missing. Check the consolidated version and the date of each agreement.

The Valencian tourist-home procedure covers paid use of a complete, immediately habitable home for tourist purposes for up to ten consecutive days with the same guest. Platform listings and other circumstances may add further obligations. Classify the real activity before combining regimes.

For tourist use, check the municipal report for the cadastral unit, building rules and decisions, regional entry, insurance and national platform number where required. Our tourist-permit guide explains these checks. A number held by the seller may not authorise the new owner.

For habitual or temporary housing, seek advice on duration, extensions, deposit, rent adjustments and both parties’ rights under the current Act. A short term alone does not make the agreement a temporary housing contract. Document the real reason and, where relevant, the tenant’s usual home. Contract labels do not remove legal protections.

Compare net figures, not advertisements

For holiday letting, model realistic saleable nights, net nightly rate, seasonality, platform fees, management, cleaning, utilities, replacements, permits and insurance. For residential letting, model collectable rent, vacancy, repairs, insurance, management and contract obligations. Both need community charges, local property tax and fixed costs from our annual ownership costs guide. Another operator’s occupancy claim is not a forecast for your home.

Tax treatment depends on the activity, services and dates. The Spanish Tax Agency announced a VAT change for certain short stays from 1 December 2026. It had not yet taken effect on this guide’s review date. Check the current rules before invoicing. Do not present an after-tax return without the owner’s actual tax position.

A practical choice

  • If you want a year-round tenancy with fewer guest changes, study habitual letting and its legal obligations; timely payment is never guaranteed.
  • If you want to use the property yourself part of the year, first verify that tourist use is possible at that address and cost it realistically.
  • If someone suggests repeated “temporary” agreements to avoid habitual-tenancy rules, examine the genuine cause and legal risk before buying or listing.

Common questions

Can I switch regimes after buying?

Perhaps, depending on the property, owners’ association, municipality, registers and existing contracts. Never assume an immediate switch.

Is holiday letting always more profitable?

No. Compare net income, nights actually sold, management, tax and vacancy. Alicante has no universal yield figure.

Can I relabel an unlicensed tourist unit as temporary housing?

Only a genuine temporary housing need and compliance with applicable law can support that contract. A different listing label does not change the underlying activity.
