Buying a Benidorm apartment to let: due diligence before investing

A compelling apartment and projected income in an advertisement are not enough to make an investment decision. Two nearby Benidorm homes can have very different running costs, owners’ association rules, physical condition and permitted rental uses. This guide was reviewed on 1 November 2026. Obtain current property-specific evidence before paying a deposit.
Identify the property and its legal position
Request a recent extract from the Property Register and check the owner, description and charges. The Spanish registrars explain what a nota simple shows; an old copy may miss later changes. Compare the deed, area and cadastral reference with the local tax bill and physical unit. The Cadastre explains cadastral references and accessible data. Document any mismatch before assessing the purchase price.
Check for occupants and existing tenancies, use restrictions, approved special assessments, unpaid community charges and planned works. Obtain association minutes and statutes, proof of payments, the latest local property tax bill, utility bills, insurance details and repair history. Extraordinary building expenses can materially change the true cost.
Verify permitted use before modelling returns
Choose the strategy by the actual purpose of a tenancy. Our holiday versus residential letting comparison explains why a marketing label does not determine the legal regime. For holiday use, check the favourable municipal report for this unit, community position, Valencian registration and national platform number where applicable. The tourist-permit guide covers each document. The Generalitat says ownership transfer can require a new declaration and municipal report; do not assume the seller’s number transfers.
For habitual or temporary housing, review the current Urban Leases Act with an adviser, especially the actual reason for a temporary contract. An existing tenant may have rights that survive the purchase. Understand the contract before making an offer.
Inspect the property and test demand
Visit by day and evening and, if possible, outside peak season. Assess noise, aspect, temperature, access, lift, parking, façade, damp, cooling, installations and internet availability. Walk the actual routes to services and transport from the precise address. Obtain a technical inspection where the building or unit warrants it.
Listings are not completed bookings or signed tenancies. Compare truly similar active offers by neighbourhood, area, condition, building charges and lawful rental regime; record the observation date and how long they stay listed. Seller-provided historic figures can help, but distinguish gross from net income and cancelled bookings. Do not extrapolate one summer month across a year.
Build a cautious cash-flow model
| Item to check | Evidence | Decision impact |
|---|---|---|
| Price and acquisition costs | Offer, taxes and completion budget | Total capital required |
| Permitted use | Municipality, association and registers | Feasible letting plan |
| Revenue | Dated comparables and verifiable bookings or contracts | Conservative income |
| Fixed costs | Community, tax, insurance, utilities and repairs | Costs without guests |
| Variable costs | Management, cleaning, platforms, repairs and voids | Net operating result |
Our annual ownership cost guide helps capture expenses that continue without bookings. Model a base case and an adverse case. Separate operating return from financing and the owner’s tax position. The Tax Agency announces a VAT change for certain short lets from December 2026; do not assume today’s tax treatment will apply throughout next year.
Common questions
Is the seller’s tourist licence enough?
No. Verify registration, holder, municipal file, association and ownership-transfer requirements.
Will every beachside apartment let well?
Demand also depends on all-in price, condition, access, season and lawful use. Test comparables; occupancy is never guaranteed.
Can I advertise a yield before buying?
Only a transparent scenario based on identifiable data and explicit assumptions, never a guaranteed result. Avoid generic portal figures.
