Holiday letting on the Costa Blanca: permits and checks before you buy

A sea view does not make a property a lawful holiday let. Before buying to rent by the night, verify the individual property, municipality, owners’ association and relevant registers. This guide was reviewed on 1 November 2026; rules can change, so repeat the checks before advertising.
What the Valencian tourist-home procedure covers
The Generalitat’s tourist-home procedure describes paid use of a whole dwelling, ready for immediate occupation and offered for tourism, for up to ten consecutive days to the same guest. Not every temporary stay or seasonal tenancy falls into that category. Classify the real use before selecting a contract or listing platform; a different label does not change the underlying activity.
Four separate permissions and records
- Municipality: obtain the favourable urban-planning compatibility report for tourist use, or the applicable equivalent, and check current municipal rules for the precise address and cadastral reference. A neighbouring listing is no evidence for this unit.
- Owners’ association: review statutes, minutes and relevant approvals. An official 2026 decision explaining sections 7.3 and 17.12 of Spain’s Horizontal Property Law describes the express approval requirement for tourist activity in buildings subject to that regime, according to the applicable dates. Do not assume a seller’s permission transfers automatically.
- Property and operator: check the individual cadastral reference, occupancy title, safety, capacity, right to use the property for this activity and liability insurance. The Valencian declaration procedure lists the documents and statements required.
- Registers and platforms: verify regional registration and its conditions. For short-stay listings on digital platforms, check the national Single Rental Register and Digital Single Window. A national number does not replace municipal or regional requirements.
Subject to statutory exceptions, Valencian registration lasts five years. The Generalitat also states that transfer of ownership calls for a new declaration and favourable municipal report or equivalent. Ask for current evidence rather than relying on a number in an old advertisement.
Model net income conservatively
Use nights that can realistically be sold, a realistic net nightly price, seasonality and vacancy. Subtract management, platform fees, cleaning, utilities, community fees, local property tax, insurance, repairs, replacements and compliance. Our guide to annual costs of a second home covers expenses that continue even without bookings. Another operator’s advertised yield is not a forecast for your property.
Tax depends on the owner, services and dates. The Spanish Tax Agency reports an upcoming VAT change for certain short stays from 1 December 2026. Ask a tax adviser to review the current rules before setting prices or issuing invoices; an old exemption rule may soon be wrong.
| Check | Evidence to request | Risk if absent |
|---|---|---|
| Municipal use | Favourable report for this unit | Use not allowed at this address |
| Building community | Statutes and applicable approval | Dispute or prohibited activity |
| Regional register | Current entry and operator | Expired or inherited number |
| Platform | National number where needed | Non-compliant listing |
| Finances | Costs and prudent occupancy | Inflated net income |
Common questions
Is the seller’s claim of a licence enough?
No. Verify the register, operator, municipal report, community position and transfer requirements.
Can I buy first and seek permission later?
You can buy, but tourist use may prove impossible. If letting is essential to the purchase, examine the property-specific file first.
Could a home without tourist permission be let long term?
These are different regimes. The actual residential or seasonal purpose, contract and current rules must be reviewed separately. Lack of tourist authorisation does not, by itself, decide every other type of tenancy.
