Can you buy property in Spain without being a resident?

Owning a home in Spain and having the right to live there are different questions. In general, you can consider buying without already living in Spain, but your personal status, the property and the transaction still need checking. This guide focuses on the non-resident buyer's decisions; our step-by-step guide for international buyers covers the full purchase journey.
Three separate questions
| Question | What it addresses | What it does not prove on its own |
|---|---|---|
| Purchase and ownership | Buying and registering a property | Permission to reside or remain indefinitely |
| NIE | Identifying a foreign person in Spanish procedures | A residence or work permit |
| Residence | Immigration status and, separately, tax residence | It is not created automatically by owning a deed |
The Spanish National Police explains NIE applications for foreigners with economic interests in Spain and the consular route for applicants abroad. Our NIE guide lists the documents and steps without promising an appointment date.
Do nationality and intended length of stay matter?
They matter for entry and residence, which must be considered separately from buying. Your Europe explains the property rights of EU citizens. For a stay of more than three months, the Spanish administration describes EU citizen registration and its conditions. If you are not an EU citizen, ask the relevant consulate or authority which entry and residence rules apply to your nationality and purpose. Do not infer a permitted length of stay from the purchase price or the deed.
Spain's former real-estate investor residence route ceased taking new applications under Articles 63–67 of Law 14/2013 from 3 April 2025, as shown in the consolidated BOE text. Earlier cases have transitional rules and require individual advice. A 2026 purchase should not be planned around old “golden visa” advertisements.
Prepare the transaction from abroad
- Identity: confirm the NIE, passport and, if someone signs for you, the form and scope of the power of attorney with the competent professionals.
- Funds: ask your bank what evidence of identity, source of funds and transfers it needs. If borrowing, obtain terms for your actual profile. An informal pre-assessment is not final mortgage approval; do not commit to a deposit timetable that depends on one.
- The specific home: request a recent land registry extract and compare owner, property description, charges and associated spaces with the home you visited and the contract. The Spanish government outlines the legal checks.
- Total cost: separate price, applicable tax, notary and registration charges, and any professional services you choose. Our Alicante buying-cost guide provides a line-item budget. Your tax residence and intended use may affect later obligations; seek advice for your circumstances.
- Signing and aftercare: have the reservation or deposit agreement reviewed for parties, deadlines, title, charges, handover and payment instructions. Our guide to the registry extract, deposit and deed helps organise the documents. After signing, follow up registration, the cadastre, utilities and recurring taxes using our post-purchase checklist.
If you are managing the purchase from another country, our Alicante remote-buying guide organises viewings, representation and payments by milestone.
Three practical scenarios
Holiday home: plan permitted visits, keys, maintenance and property-related tax duties. A future move: identify the residence route that applies to you before choosing a home; ownership does not replace its requirements. A mortgaged purchase: request written lending terms and a complete budget before agreeing payment dates. None of these scenarios guarantees bank approval or an immigration outcome.
Must I already live in Spain to buy before a notary?
Do not treat residence as a universal purchase prerequisite. You must identify yourself and meet the requirements of the specific transaction. The notary, lender and your advisers may need additional documents.
Does an NIE let me live in Spain?
No. It is an identification number. Check the separate entry and residence rules that apply to your situation.
Can I sign without travelling?
Representation may be possible, but the power, any legalisation or apostille, translation and acceptance should be checked before agreeing a signing date. Do not assume a generic power will be sufficient.
