NIE for buying property in Spain: documents, applications and mistakes

The NIE is the number used to identify a foreign person for certain dealings with Spain. If you are planning a Costa Blanca purchase, organise it early, but keep three things separate: an NIE, a physical residence card and the right to reside. This guide focuses on identification and an application based on an economic interest. The wider property transaction is covered in our foreign buyer's purchase guide. For property checks before paying a deposit, see our nota simple and arras guide.
What is an NIE and when might you request one?
The Spanish National Police describe assigning a Foreigner's Identity Number to people who have economic, professional or social dealings with Spain. Preparing a property purchase may provide an economic reason for the request. If you have already been assigned an NIE, check your papers before seeking another number; a different certificate or procedure may be relevant instead.
An NIE identifies you; it does not grant permission to stay or reside. The Spanish consular service expressly explains that a consular NIE does not prove or entitle its holder to residence. If you intend to move to Spain, check the separate rules that apply to your nationality and circumstances.
Documents to prepare
The official police procedure names form EX-15 and proof of payment of fee form 790, code 012. The competent office may also require valid identity documents, copies, evidence of the reason for applying and an appointment. A particular consulate may set its own instructions for copies, payment and presentation. Read that office's current guidance before sending documents or travelling.
| Prepare | Check before submission |
|---|---|
| Identity | The name matches your passport, form and transaction papers. |
| EX-15 | Complete details and a truthful explanation of the economic reason. |
| Fee form 790-012 | Current form, correct category and a payment method the office accepts. |
| Supporting reason | A document explaining the transaction if the office requests one. |
| Representation | Sufficient authority and the representative's identity document if someone else applies. |
Do not rely on a fee amount from an old article. The Police provide the current fee form, and the chosen office may specify additional requirements.
Applying in Spain or from abroad
Within Spain, the Police refer applicants to the Directorate-General of Police, relevant Immigration Offices or police stations. For someone still abroad, their procedure points to Spanish consular offices. Territorial responsibility, appointments and paperwork can vary between offices. Official consular guidance distinguishes a personal application from one submitted by a duly accredited representative. Do not assume an informal authorisation, an unverified copy or an appointment in the wrong consular district will be accepted.
Mistakes to avoid before committing to a purchase
- Treating an NIE as a residence permit or as the foreigner's residence card.
- Arranging an appointment too close to the signing date and promising a date controlled by another office.
- Using inconsistent names or passport numbers across the reservation, application and mortgage papers.
- Paying the wrong fee category or following another consulate's local instructions.
- Giving original documents or personal data to an intermediary without checking who will receive them and why.
